Rule 87
Missing Servicemen's Pension and Gratuity
(1) If a military person goes missing and is not found dead for two years, the amount of gratuity or pension received by such military person according to rules 79 and 80 shall be given to the person he wishes or to a person close to his family.
(2) Notwithstanding anything written in sub-rule (1), if a person who has reached the period of receiving pension according to rule 80 disappears before receiving pension, up to seven years and if he disappears after starting to receive pension, up to the remaining period of seven years, the person he wishes or a person close to his family will be entitled to the full amount of pension. amount and after that period the husband or wife will be given half of the lifetime pension as family pension.
(2a) Notwithstanding anything written in sub-rules (1) and (2): if any soldier goes missing during military action or military operation, the nearest relative of his family shall receive family pension and family allowance as per sub-rule (6) of rule 2.
(2b) Notwithstanding anything written in sub-rules (1), (2) and (rock), if any military person goes missing during military operations or military deployment, the next of kin of such a military person will also get the facility as per sub-rule (7) of rule 12.
(3) A person who is later found to be not entitled to claim any gratuity or pension or family pension that has been paid in accordance with sub-rules (1), (2), (2A) and (2B).
